Enforcement of Court Orders in Ontario: How to Collect Money Owed to You
Obtaining a court order or judgment is an important step toward recovering money owed to you. However, receiving a judgment does not always mean that the debtor will pay voluntarily. If you have obtained a judgment through the Ontario Small Claims Court and are still waiting for payment, you may need to take further steps to enforce it.
Y M Paralegal Services can assist you with enforcing court orders and judgments in Ontario and help you understand the available options for recovering the money owed to you.
What Are Your Options for Enforcing a Court Order?
The appropriate enforcement method depends on the circumstances of your case and the information available about the debtor's financial situation.
1. Garnishment of a Bank Account
If you know where the debtor banks, you may be able to pursue enforcement through a garnishment of the debtor's bank account. This process may allow funds held by a financial institution to be applied toward payment of the judgment, subject to the applicable legal requirements and procedures.
Having reliable information about the debtor's bank can help determine whether this enforcement option is appropriate.
2. Garnishment of Employment Income
If you know where the debtor works, you may be able to pursue a garnishment of wages. This involves obtaining the appropriate court process to have part of the debtor's employment income redirected toward payment of the outstanding judgment.
The amount that can be collected depends on applicable legal requirements, exemptions, and the debtor's circumstances.
3. Examination of the Debtor Through an Examination Hearing
What if you do not know where the debtor banks or works? You may still have options.
An examination hearing, sometimes referred to as an asset examination, can help you obtain information about the debtor's financial circumstances. Through this court process, the debtor may be required to answer questions about their income, employment, bank accounts, assets, liabilities, and other relevant financial information.
The information obtained may help you identify potential sources of recovery and decide which enforcement steps to pursue next.
Which Enforcement Method Is Right for Your Case?
There is no single enforcement method that works in every situation. The best approach depends on what you know about the debtor, the amount outstanding, and the debtor's financial circumstances.
If you already know the debtor's employer or financial institution, garnishment may be an option to consider. If you lack information about the debtor's assets and income, an examination hearing may help you obtain the information needed to plan further enforcement.
In some cases, more than one enforcement method may be appropriate.
